One obvious outcome could be that if the Supreme Court deems unconstitutional what is arguably the hallmark of Obama's administration, Obama would look like a "weak president." If the Supreme Court overturns the PPACA, Obama's singular domestic achievement would be compromised and his campaign would be seriously weakened by this setback. However, Obama's loss could be the Democratic party's gain. Republican consultant John Feehery argues that though the Supreme Court's decision could hamper Obama's campaign, "it puts healthcare back on the agenda for Democrats... [whilst taking] away a law that is unpopular."
On the other hand, if the Supreme Court overturns the PPACA, Romney would have to come out of the bushes with his stance on American healthcare. He would no longer be able to get away with vaguely talking about getting rid of "Obamacare" and have to come up with a detailed strategy to salvage the American healthcare system. It may not be in Romney's best interest, however, to exploit the possible Supreme Court ruling since his similar "individual mandate," that he pushed as Massachusetts governor, was a model for "Obamacare." Criticism of Obama's reform could thus strengthen the Democrat's assertion that Romney is an "Etch a Sketch" candidate, waning back and forth on tough issues.
So what happens if the Supreme Court rules in favor of Obama's Patient Protection and Affordable Care Act? It would undoubtedly be a resounding victory for Obama and his administration, and would still push Romney out of his hiding place with regards to his stance on healthcare. Romney would be forced to stick to his tired explanation of how "Obamacare" is in any way different from, what Rick Santorum calls, "Romneycare." However, this decision could cause an uproar by the Republican Party, which is already terrified that Obama is a raging socialist, and will spur them to see a Republican victory as the only way to keep Obamacare from turning America into a socialist nation.
Regardless of how the Supreme Court rules, this election season has already proven to be a heated and rather interesting exhibition of party polarization. In less than two month's time, the Supreme Court will release its decision, but until then, Romney and Obama's only option is to wait it out and perhaps enjoy a steaming plate of broccoli casserole.
